Terms and Conditions

Rules governing use of the Dimple website and software operated by Dimple Dental LLC, doing business as Dimple, and the terms that apply when a user opts in to receive text messages from us.

1. Acceptance of the Terms

By accessing or using dimple.dental, the Dimple software, or any Dimple messaging program, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the website or the service. SMS-specific terms (Section 6) apply only when you separately provide affirmative consent to receive text messages. You must be at least 18 years old to use the website or the service, and if you act on behalf of a dental practice or other organization you represent that you are authorized to bind it.

2. The service

Dimple is software for dental practices that answers telephone calls and text messages, books appointments into the practice's schedule, sends reminders and follow-ups, and reports what it did. Dimple identifies itself as an AI assistant at the start of every call. Dimple does not provide dental, medical or legal advice, does not diagnose, and does not replace the judgment of the practice's clinical and administrative staff. Appointments requested through Dimple are confirmed only when the practice's own scheduling system confirms them.

A separate written agreement (the Practice Agreement, which includes a Business Associate Agreement) governs a practice's subscription. If these Terms and a signed Practice Agreement conflict, the Practice Agreement controls for that practice.

3. Accounts and eligibility

Staff accounts are created by invitation from a practice. You are responsible for keeping your sign-in credentials and second-factor device secure, for all activity under your account, and for telling us promptly about any unauthorized use. We may require two-factor authentication and may sign out inactive sessions on shared devices.

4. Acceptable use

You may use the website and the service only for lawful purposes and in accordance with these Terms. You may not: interfere with or disrupt the service; attempt to gain unauthorized access to any account, system or data; introduce malicious code; misrepresent your identity or authority; use the service to send unlawful, abusive, deceptive or unsolicited messages; use patient information for any purpose not permitted by HIPAA and the Practice Agreement; or copy, scrape, reverse-engineer or resell the service. We may suspend or restrict access when reasonably necessary to protect the service, our customers, patients or the public.

5. Fees, billing and cancellation

Subscription plans, included usage, overage rates and add-ons are published at /pricing and in the Practice Agreement. Plans are billed monthly (or annually, when selected) per location, in advance, by card through our payment provider. Usage beyond a plan's included amount is charged at the published rate only after we have notified the practice at 80% and at 100% of the included amount. Plans are month to month unless an annual plan is selected; a practice may cancel from its billing screen, and cancellation takes effect at the end of the current billing period. Fees already paid are not refunded except as required by law or stated in the Practice Agreement. Taxes are the practice's responsibility where applicable.

6. Dimple Dental LLC SMS Messaging Program

Program description. When you affirmatively opt in, Dimple Dental LLC (Dimple) may send text messages to the mobile number you provide.

  • Non-marketing messages may include replies to your inquiry or demo request, account and security notices such as one-time sign-in codes, staff invitations, setup and support messages, and billing notices connected to your account.
  • Marketing messages may include product updates, offers for founding practices, event invitations and similar promotional communications, but only when you separately opt in to marketing messages.

Consent to receive text messages is voluntary and is not a condition of purchasing any Dimple service. Marketing and non-marketing consent are collected separately.

Message frequency and charges. Message frequency varies based on your interactions with us and the categories you select. Message and data rates may apply to messages we send you and to messages you send us. Contact your wireless carrier with questions about your text or data plan.

How to opt out. You can cancel the SMS service at any time by replying STOP to any message from the program. After you send STOP, we will send one text confirming that you have been unsubscribed, and you will receive no further messages from that program unless you opt in again.

How to rejoin. To rejoin after opting out, complete the same opt-in process you used originally, or reply START to a message from the program, or otherwise provide new affirmative consent through an authorized sign-up method.

Carrier disclaimer and delivery. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and network availability. We do not guarantee that every message will be delivered or received within a particular time.

Privacy. Our collection and use of information related to the SMS program are described in our Privacy Policy. Mobile information and SMS opt-in data are not provided to other parties for their own marketing or promotional purposes.

Industry and legal compliance. The SMS program is intended to operate in accordance with applicable federal and state law, including the TCPA, carrier requirements, and CTIA messaging principles. You agree not to use the program to transmit unlawful, abusive or misleading content.

Your authority to enroll. By opting in, you confirm that you are authorized to use the mobile number provided and to consent to messages at that number.

Patient messaging programs. Text messages that Dimple sends to a dental practice's patients are sent by that practice, under that practice's own consent process and its own registered messaging program. Those programs honor STOP and HELP in the same way; the practice is the sender and the point of contact.

7. Practices, patients and HIPAA

A practice that uses Dimple is responsible for obtaining any consent its patients must give for calls, recordings and text messages under the laws that apply to the practice, for the accuracy of the information it enters into Dimple's knowledge base, and for reviewing what Dimple reports needs a person. Dimple handles patient information as the practice's business associate under the Business Associate Agreement and the Privacy Policy, Section 7. Dimple does not go live on real patient data at a practice until the Business Associate Agreements on both sides are in place.

8. Intellectual property

The website, the software, and their text, design, logos, graphics, screenshots and other content are owned by or licensed to Dimple Dental LLC and are protected by applicable intellectual-property laws. Subject to these Terms, we grant practices a limited, non-exclusive, non-transferable right to use the service for their own operations during their subscription. A practice owns the information it enters and the patient data it entrusts to us. You may view and print reasonable portions of the website for personal, non-commercial use; no other reproduction, modification or distribution is permitted without prior written authorization. "Dimple" and the dimple mark are trademarks of Dimple Dental LLC.

9. External websites and service providers

The website and service may link to or rely on services operated by other companies, such as payment processing, telephone and messaging delivery, practice management systems, maps, and analytics. Those services have their own terms and privacy policies. We are not responsible for their availability, content or independent practices.

10. Disclaimer

The website and the service are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, and the accuracy of any AI-generated summary, transcript or answer. Dimple is a tool that assists a practice's staff; the practice remains responsible for its schedule, its patients and its clinical and business decisions.

11. Limitation of liability

To the fullest extent permitted by applicable law, Dimple Dental LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost patients, or lost data, arising from use of or inability to use the website or the service, reliance on content or AI-generated output, or use of external services, even if advised of the possibility. Our total liability for any claim arising from the service in any twelve-month period will not exceed the fees the practice paid to us for the service in that period. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

12. Indemnification

You agree to indemnify, defend and hold harmless Dimple Dental LLC, its officers, employees, contractors and agents from and against claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the website or the service, your failure to obtain consents required of you, or your violation of any law or the rights of a third party.

13. Termination

We may suspend or terminate access to the website or the service for a material breach of these Terms, for non-payment, when required by law, or when reasonably necessary to protect patients, customers or the service, with notice where practicable. On termination of a practice's subscription, the practice's data is returned or securely deleted as the Practice Agreement provides. Sections 8 and 10 through 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where federal law controls. Any dispute relating to the website, the service or these Terms will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction, subject to any dispute-resolution provision in a signed Practice Agreement.

15. Changes to these Terms

We may update these Terms to reflect changes in the website, the service, the messaging program, our business practices or legal requirements. Updated Terms will be posted on this page with a revised effective date. Your continued use after publication means the updated Terms apply to future use.
